Services Licensing Terms

1. License Grant

By purchasing our real estate photo/video listing services, you agree to the following terms and conditions (“Terms”). Visually Appeal LLC (“Company,” “we,” “us,” or “our”) grants you a non-exclusive, non-transferable, and revocable license to use the photos and videos (“Content”) created by us solely for the purpose of marketing the property associated with the specific listing for which the Content was created.

2. Usage Restrictions

You may not:

  • Resell or distribute the Content to third parties without our explicit written consent.
  • Use the Content for any purpose other than marketing the specific property.
  • Modify, alter, or edit the Content in a way that misrepresents the property or misleads potential buyers or renters.

3. Ownership

All intellectual property rights in and to the Content, including copyrights and any related rights, are owned by Visually Appeal LLC. You acknowledge that you do not acquire any ownership rights in the Content through this license.

4. Permitted Usage

You may use the Content on various platforms for the purpose of marketing the specific property, including but not limited to:

  • Property listing websites.
  • Real estate agency websites.
  • Social media platforms.
  • Printed marketing materials.

5. Termination of License

This license is valid until the property associated with the Content is sold or rented, or until terminated by us for any reason. Upon termination, you must cease using the Content and delete or destroy any copies in your possession.

6. Cancellation and Refunds

If you choose to cancel our listing services before the Content is created, you may be eligible for a refund according to our refund policy. Once the Content is delivered, no refunds will be provided.

7. Indemnification

You agree to indemnify and hold Visually Appeal LLC harmless from any claims, liabilities, damages, losses, or expenses arising out of your use of the Content in violation of these Terms.

8. Governing Law

These licensing terms shall be governed by and construed in accordance with the laws for the city of San Jose. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts in the city of San Jose.

By purchasing our listing services, you acknowledge that you have read, understood, and agreed to these licensing terms.
